And notwithstanding critique as follows, as the holder of probably the most prominent legal ‘test case’ this century - designed so by the President of The family courts in The Appeal Court [2006] – staged and set up as a media event..., which incidentally is taught in law school nowadays as a rather interesting REAL legal cultural development..., i have often in the past commended Leigh Day in taking public obvious GENUINE injustices towards the small person. I often hear the name on Radio 4. I would hate to see you lose GENUINE credibility for genuinely important legal work...
In short as many year - from mid 90s, concerned citizen in respect of the environment of that region – around Hay-on-Wye i was domicile from 1994 for near 20 years, and even one of four founders of Hay friends of The earth, this case is a sop.
Several of us many years of that region have even been contacted via your massive PR campaign fishing for more litigants to join in to your sop ‘environmental’ case. That alone is a scandal. All that expensive advertising fishing for litigants... Facebook and i am sure elsewhere...
I wrote to Avara and Cargill several times over the last six months explaining why. I now intend to seek more coverage of my chronicle of the actual FACTS. Most briefly alluded to in this email – or rather the first sent out earlier this year... all which will be improved over the next few months.
This email will be copied to one of the litigants – i shall not name her to save her embarrassment for now – a semi prominent public figure i have known for around 23 years... a FORMER resident of the HAy region. I happened to encounter at the beginning of this year. She smugly echoed her ‘activism’ in this non case. As it happens one of many whom for two decades did nothing – now pretending to be Joan of Arc... . Except (as can be proven by clear evidence trail) made underming personal comment towards the few of us who, did try... though as so often with that region of chancers and pseuds, behind ones back. Especially mine.
And now they all join in in the pretence that any of them may have even considered the quite STANDARD process of democratic checks and balances (from roughly the late 00s) to any perhaps inappropriate development ..anywhere in the world.
The actual facts are laid out in various emails and other material online i have made sure a fair few trusted and actually MORAL people have seen over the last 6 months. I am not alone....
And the simplest summary of the reason this whole matter is quite immoral is that a whole cohort of ‘Guardian Reading’ headless chickens did absolutely NOTHING over at least 15 years - none of the quite standard ordinary ‘lobbying’ - power, MPs etc... and just as important entirely failed to use their access to public opinion – Hay trading on a major media presence for 20+ years.....until... well a cynic may say a payout seems possible. Or at least another appearance of the Today programme – what they are really after – to show off to their friends.
And in fact i have had various friends along that river who over the important period – 2005 ish and on... would, when actual specific environmentally negative events were reported in to them... do nothing. Not even bother with a letter to an MP... (some my proper ex friends even being related to local politicians).
As a full time environmental steward of sorts and engaged in the real politics of this whole region from a sustainability point of view i have a perfect diary and also the last decade chronicle of every encounter recorded..(for ‘posterity’)... all day every day High Street chats included
MY only interests are two fold. Firstly as an example to the next generation false litigation to me is immoral and secondly the huge amount of time and money and luvvie-hot-air... most of it extremely sour breath often aimed at me as it happens... i would wish were turned into something real. And the only ‘real’ thing there is is good culture that explores truthfully THEIR utter failure to actually protect that river ..
(and from mid 2000s i would posit that a fair bit of the chemical damage comes from inadequate domestic arrangements as the population of the region considerably expanded from around then – all of them – incomers...leave out of their complaints)
World famous philosopher and public intellectual A C Grayling told me in Hay 2019 i had a responsibility to do just that if what i have on file is indeed truth...
An example of major domestic waste increase is indeed that ‘camping’ ‘glamping’ itself carried out on the land of one chief luvvie... I am quite sure has massively increased chemical added to waste waters and i am quite sure without concomitant systems upgrade (i appear in a BBC documentary on me, with.. her, in 2004...)
A whole range of issues that simply ruined The wye from about 2007 are present all over the country nowadays, and myself as an ACTUAL ‘environmentalist’ i believe this vexatious litigation – the worst kind of crocodile tears in fact (whilst some of us from that time shed REAL tears these luvvies would never help us attempt to protect the river my daughter learned to swim in...from 1998), neglects the ONLY story – i say as a real environmentalist, the failure of the citizenry – those the kind you have on your books in this case, to EVER do lawful standard hard lobbying work in the past.

The intellectual paucity of any of this (i have followed as ‘campaigning’ and in fact worked with the few sane politicians of the region the last decade) is out of a cartoon. The notion that anyone could fix the water systems even with 50 billion pumped in over a decade is rather silly. “The environment” being largely in fringe low population density areas where many properties and small village systems are entirely unable to seal in waste water - especially as person-hour per toilet or bathroom has massively expanded as teleworking became fashionable, and thinking there is any fix to this is absurd. Only a message to use far less domestic chemical is moral and sane. Even if all 50 billion were efficiently spent to seal in all domestic chemical egress everywhere it would be many years... but all Fergal and Co ever do is blame someone else...rather than nicely explain to everyone, often... only using far less domestic chemicals at home can make any real difference.
I would like a REAL difference to be made. Your litigants are only delaying that, diverting attention into false claims of ‘damage’...
I HATE the chicken sheds taking over my past area of residence...but any sane community would have managed to considerably hold them back 15+ years ago...

ohhh PS ... singlehandedly in early 2010s i had HAy festival roasted over the coals by radio 4 for having "EOS first class only airlines" as their main sponsor....whist also featuring MANY so called 'Green' speakers... then a year later singlehandedly - no one helping..i published material stating that clearly the then festival director had links with a property developer who were in the scheme to build a large supermarket in the centre and relocate the school.. the 'legal' defence against that scheme ongoing a year .. halted a few days later after i published a picture of someone shopping in Hay COOP...captioned 'dont worry Becks Peter is buying you a new WAitrose soon' the whole scheme was dropped that week..after being supposedly ongoing several years. me alone... I was surprised not to receive ANY reply.
In short i have done more work, with colleagues, on the issue and we will be putting the material below into the public domain in the UK most actively over the next few months. My position is in Cargill’s benefit.
The legal case against Avara (claim for damages by the people surrounding the iconic River Wye) has received more publicity in the UK (often referred to on the BBC) than any other environmental matter for decades. The most famous ‘citizen law’ company Leigh day acting for the plaintiffs have been mass advertising to attract further plaintiffs. Potentially 1000s.
As a resident of that area – close to that river, for 20+ years that disgusts me. It is blatant vexatious litigation. And i am the region’s most active real environmentalist for many years.
I have not yet contacted Leigh day myself but if i copy this message to them it will certainly set off alarm bells. I would imagine cause them to reconsider even supporting the vexatious case.
I add to the initial message below stating as follows.
I have a range of public figures known to me - all environmental stewards or extremely concerned about the environment whom agree with my position (this whole case is immoral). I am a part time journalist of sorts and have many recordings of discussion on this subject, for example with Jo Penberthy a well known Anglican bishop (retd) in Britain (the main established church here). She supports me taking this forward now.
And recorded discussion with various figures who work within the UK national Environment Agency (interestingly and relevant highly attractive women in their 30s who are mothers and know that such litigation as this merely diverts from the REAL issues – domestic pollution going into our rivers no one ever even addresses in public and THAT we should put our efforts into)
I have several B list actors and other cultural names who i know will support me.
In fact above all over the last few months the ‘solution’ that has organically arisen is the we must make film – cinema, to focus people on how farming is NOT the main problem in the UK – where ALL our rivers are polluted as the incoming Labour government announced a few months ago (creaking infrastructure especially water collection) but in fact excessive flushing of domestic chemicals INto the environment in rural areas where sewerage treatment is minimal and never designed to process the plethora of household chemicals entering the household sewerage. (UK had a massive flight from the cities from 2016 – middle class white flight. Due Brexit. TO many areas the Wye Valley the MOST popular. Their sewerage has ruined that river as much as any farming.
A second factor being a Total SOP in that the authorities do not test adequately FOR such domesticly originating pollutants.
These things i and others now dedicate the rest of our lives to somehow highlighting via interesting engaging media. Even comedy. All are welcome to help.
We will NOT receive any help from any environmental campaigning organisation because all are cliques. Dilettante woke little Hitlers – they were my people for 20 years. But all only self interested (getting on television). And my own main thrust is making THAT film – showing that ‘movement’ for the effete failures they all are (i have 10 years of undercover recordings of 100s of them failing to do anything ever but bitch about their fellow group members).

I am writing to you with reference to the most high profile legal claim against Avara in respect of the river Wye.
In short, as by far the most prominent and successful legal campaigner resident in that region from 1994, and most focused environmental steward and campaigner from 2007 (a founder member of Hay-on-Wye Friends of The Earth) if, and when, one celebrity plaintiff in this case – known personally to me 23 years, reads this email if forwarded , she will realise they have something of a problem. Likely reconsider the whole action. (as will River Action). I am a nationally prominent legal campaigner. Various Hay connected people know this. I was VERY well known there - including in person to the founder/ festival director Florence )
(I am also known to Leigh Day as a legal precedent i took forward is taught on law courses, and if they are aware of this they will also realise they have a problem).
I shall lay out bona fides at the bottom in footnote but in summary for now, although a modest rural person, I am literally 3X Erin Brockovich. Quite alone i took forward arguably the most consequential legal test case the Royal Courts of Justice has hosted this century (staged in 2005-6 – meaning the most powerful Appeal Court judge at the time orchestrated my cause as a “test case” to quote his words in 2005). I also quite alone* caused the Minister of Justice Jack Straw to make a public U-turn in 2009 after he announced in The House of Commons he was in effect reversing primary UK legislation (in effect – the 06 precedent being at the highest level) in my name. I do not take prisoners. My 2006 successful legal cause affected the business in more RCJ courtrooms than any other for someyears.
This communique: Having become aware of the new case last month frankly i am shocked at the perversity and immorality. I am an intellectual (of ethics among other things) and do not use the word ‘immoral’ lightly.
The reason i feel this way is that above all i became an environmentalist as of the mid 00s. (but this was only a return in that i had been brought up by a true committed environmental steward in a very rural area of N Wales). I lived by the Wye from 1994 and my own daughter 25 years ago age 6 months dipped her toes into that river where we would spend all summer (At ‘Hay Beach’ – The Warren, 2 km upstream of Hay-on-Wye). That summer 1997 there were many minnows nibbling at her baby feet. By her 10th year at that same river the minnows were dying off and as we know by around 2013 the river was on its way to dying – as good as dead . Many true country people said so often.
From 2007 I have been most active in the whole region from Brecon all the way to Hereford, but especially at the PR heart of the region Hay-on-Wye as environmental activist. My role has been among the supposed green, environmentally aware people, attempting to rally the troops to research and lobby and explore all lawful lobbying and pressure methods to indeed protect the dying river.
In short, the growing number of environmentally ‘aware’ people in the region from around 2007, simply did nothing. EVER. Which is why i feel the action is immoral.
I say this as also a ‘chronicler’. By which i mean as follows: I am a book man. Proper literature and also science. The ‘story’ of the Wye i realised from 2007 was that many ordinary people sought to gain attention to themselves by seeming to ‘care’ about the slow death of the river, but in fact did nothing; and worse, only acted in ways that damaged any possible solidarity among those of us who may have gradually mounted the standard citizenly counterbalance to all development. It is the personal behaviour of people – many my once friends, that is the cause of complete failure to protect this region. I neither (any more) blame politicians or industry, only the ‘people’.
That sounds fluffy (and i have no axe to grind). To fully describe those 15 years (my last interest and in fact action in that region was 2022) will take a 5 page essay and a certain amount of going back into my 100% accurate evidence trove of records of meetings, emails, and many failed attempts at kindling that necessary solidarity. I tape recorded almost all encounters (as a record, and also ‘protection’)
In 2019 i met and had a long intimate talk with one of the UK’s most prominent public intellectuals, AC Grayling, in Hay-on-Wye. I chronicle and loosely journalise all and the talk is recorded. He spoke of being very dedicated to the environment (in fact a true supporter of just started Extinction Rebellion) . I told him of my sad chronicle of the environmentalists being disastrous and effete over 10 or more years and he said that this must one day be published for the sake of the next generation.
Naturally this is to some extent sad for me. Total failure. But on behalf of my own daughter’s generation, indeed truth i feel is far more necessary for them. Is my own crusade. And thus for 5+ years i have been only committed to this ‘truth’ - the river Wye being advertised to the world with emotive photos, in headlines April 2020 as having gone ‘toxic’ (in the Hay region).
To summarise my own many years of liaising with the environmentally ‘aware’ in that region, I have only ever encountered, and exhaustingly lived, endless virtue signalling from the middle class pretend environmentally aware. But it is their currency; ‘bunny huggers’ displaying performative ‘green’. And all of their Facebooks gradually became their stage. NONE ever did anything though.
Indeed the very few who perused any line on the river Wye, - for example one a many year close acquaintance of mine, and 5 year neighbour – a rich semi aristo family of the region (involved in politics, her brother the county councillor ), it was if the pinnacle of achievement was to achieve the radio 4 slot speaking about the Wye - she did 2020. But all such people did nothing ever to encourage grouping into professional lobbying . And of course from around 07ish every conversation included “Cargill this Cargill that” i am fully aware of the real politique of Herefordshire, Cargill being a major employer. Many said even 17 or 18 years ago creating perverse incentive for development. I have no interest in that myself. My only interest is recording the facts: no coherent lawful lobbying to resist by ANY green group.
I have been officer in the Green Party (N Herefordshire Greens most active greens by far in that whole region – Powys, North and South Herefordshire) ) and one only encountered narcissism and complete dysfunctionality. Hundreds of meetings or informal gatherings in that whole region from 2007 not one person ever took forward and mature citizenly plan to create standard democratic truth to power.
I would also add - though possibly not quite at the core of the legal case, that from 2005ish the massive expansion in tourism and Hay-on-Wye becoming major visitor destination, and likely doubling of occupancy of the region – meaning some new build and so much barn conversion etc (my father actually INVETED in UK in the late 60s a famous architect popularising this through RIBA magazine), are major factors to the initial Wye destruction well under way by the second part of the 90s. Few wish to focus on this as most make their living from the wealthy middle and upper middle class influx (all stated only about 20 years ago). That subject (among the venal) was always steered away from.
This letter is not some wishy washy polemic. From around 2010 in disgust at the damage to the environment around Hay – the real tourist development going industrial from Hay to Glasbury-on-Wye, I have undercover 2010 film (taken at great risk to myself) of the most protected area (‘schedule 2‘) of the riverbank being industrially mined for free building shingle. Film of 100s of tons being dug up at dawn. This i reported in to Brecon Beacons National park (three times in fact - the formal moral eco authority i the region) and the aforementioned friend to lobby her politician family member. Nobody acted. I became closely associated with over 5 years from mid 00s, with the primary ‘eco tourism’ site on the Wye - The Hollybush Inn nr Glasbury, i have a chronicle of only deceit and (often druggy) nonsense, culminating in the period 2010, for a few years me filming and photographing major pollution to the Wye emanating from that very place. (the owner was a well known scoundrel who was closed down for food hygiene violations after about 10 years)
To me as a genuine eco person - and i have spent 1/3 of my waking hours on only the environment the last 15 years (especially attempting to nudge alliances forward) this region is a case study on the reality of environmentalism: that the people pretended to care, virtue signalled, but acted only like headless chickens. Worse – one knows where one is with a chicken, this lot acted like snakes. And never maturely organised to create ANY lobby. Only hissed like vipers – at each other, especially me they knew as a real campaigner. As i would often share with colleagues those years “tom tom drums never actually changed anything”. But they really seemed to believe (only) the ‘fairies’ held the key to the future of the river (“ positive connected energy” – and i mean the middle class yoga type , not the hippy class)
Latterly - from 2022, for 6 months, i became informally involved with the Liberal democrat powers of the region purely on eco matters (who knew me from my former legal campaign work, they supported). Their total dysfunction - attempting to achieve political gain from river concern, whilst unable to ever even follow through an email, i have a chronicle of.
My only purpose is no matter what this actual truth be fully written up and also filmed. I have much informal but 100%accurate journalism of this process over 15+ years. Many recordings of this dysfunction. 100s of hours.
You may or may not know that especially Hay-on-Wye IS ‘PR’. The river Wye has had a lot of BBC attention as journalists love going to hay for a day out. Hay ONLY exists (half a mil rich visitors a year or more) via PR. I am better at PR than them. That’s how i got an ‘unwinnable’ legal change through in 2006. PR. The theme park that is Hay is a PR theme park. I knew very well the man in charge of the eco side of (massive numbers) Hay Literary festival. He was a fake. As Hay Lit fest always has been (i had them over the coals by the BBC in 2010 for having their main sponsor as EOS first class only airlines when hosting MANY ‘green’ talks at £10 a ticket ). I knew the late super-Green Polly Higgins (founded the ‘ecocide’ law campaign). I asked her at Hay in 2010 to take interest in that region, but all she was interested in was personal glory for her own PR in her atomised personal glory-seeking work.
I have a many year catalogue of only fake green politicking in the whole area. Indeed i would posit that Hay became the national centre of fake green virtue signalling. For me (I am 61) now only telling that truth is the calling. The river Wye was doomed a decade ago when these children (many with inherited cash) took over the businesses, and PR of the region. One of many examples, I worked for the founder of major festival also at Hay How The Light Gets in festival – again designed to attract and cash in from hipster bunny huggers .. i looked after his land late 00s, where he would unlawfully use strong (anti bracken) pesticide close to streams flowing into the Wye (near Hay) despite it being quite unlawful. After i had counselled otherwise. Eco fraud, the whole area.
Harder to get into film or chronicle (though i have a perfect evidence trail!) , the whole region started to sell out – only cash in, i have friends who started this trend!, in ‘spiritual’ wellness retreats etc., all selling their product on being close to ‘nature’ whilst never actually doing anything to protect nature.

To hear that wealthy people who did NOTHING are suing for millions - even if not for personal profit (i assume), to me is the ultimate in fraud. I wish the next generation to know of this as salutary lesson.

I have superb chronicling and story telling skills if i sit down and create that. Obviously me writing this to you makes me look very bad to my (ex) colleagues. I have not one second of hesitation.
In fact i encountered one plaintiff on Easter Sunday in Cornwall – she is a famous writer of books about aristocrat gardens and descendent of a most famous Baronet. To hear her smug virtue signalling “ yes i am part of the action” quite disgusted me – i was frequently in her presence from 2005 and especially 2020 – 22 and not once did she ever express any coherent resistence. Only virtue signalling distress. (and she is very well connected and gets much BBC attention).
Of course i support in theory some of the approach River Action is taking nationally , however when i heard this specific suit announced (clearly VERY staged) on radio 4 i was immediately exasperated. I have circulated a cut back version of this letter to several acquaintances, so my opinions are known by a few (unlikely taken notice of all lost to this new hype).
In 4 weeks the ‘great and the good’ of national press and the luvvie world once more gather for 2 weeks at Hay Literary festival and doubtless the suit will get much pat-on-the back attention. If I am organised i may be able to start circulating a version of this communique into that gathering. I can fairly easily. I suspect it will stop the action dead. ALL involved above all care for (their ) PR above nature. All know i am a nuclear weapon. Above all to me the use of much money on a fake legal action is the most immoral thing of all.
